The FIFA Dispute Resolution Chamber has decided to order the Al-Hilal club to pay 4.5 million US dollars to the team’s former professional, Italian Sebastian Giovinco.
This happened in the context of a separation by the Chamber of a case filed by a player with FIFA after the club stopped paying fees to the player in accordance with an agreement signed between them to terminate the contract by mutual agreement.
To this amount is added an annual interest of 5% accruing from August 27, 2021 until the date of the actual payment of the entire amount, and by decision of the Dispute Resolution Chamber the International Federation was threatened that if Al Hilal Club did not undertake to pay the principal amount plus interest within 45 days from the date of notification of this decision, the following penalties will apply:
1- Al-Hilal is prohibited from registering any new players, whether nationally or internationally, until the amount due has been paid, and the maximum ban period shall be 3 full and consecutive registration periods.
2- This order must be submitted to the FIFA Disciplinary Committee in the event that the full amount (including all applicable interest) has not been paid by the end of three complete and consecutive registration periods.
3- Sanctions are imposed only at the request of the plaintiff.
The decision specifies that the decision is subject to appeal within 21 days from the notification of the parties.
On January 29, 2019, Giovinco signed with Al Hilal Saudi Club until July 31, 2022, and on August 19, 2021, both parties signed an amicable end of relationship agreement.
The third clause of this agreement states that the club must pay the player a net amount of $7 million in exchange for mutual termination of the employment contract in accordance with the schedule established by the mutual termination agreement.
